42-year-old Sutherland has said that he was sorry about what had happened to McCollough, however, although the designer has accepted the actor's apology a District Attorney spokeswoman would not reveal if the charge was being dropped.
Sutherland was alleged to have butted McCullough in an incident that happened at a party at a nightclub in the early hours of 5 May, and it was claimed that this was because the designer had bumped into actress Brooke Shields.
McCollough received a cut nose, according to a police report, however, the designer claimed his nose had been badly broken.
Sutherland is already on probation for a drink-driving conviction and is due again in court on 22 June.
