The 47-year-old actress displayed signs of "obvious impairment" when she was arrested in September in Santa Barbara, the California Highway Patrol has stated.
Ms Locklear had been arrested after she had been reported as "driving erratically" when she left a car park.
Police made the arrest of the actress in the city of Montecito, which is northwest of Los Angeles, after a patrol officer spotted Locklear’s car parked on a highway where it was blocking a traffic lane.
Ms Locklear was tested for alcohol and drugs at the police station and subsequently released from custody.
Earlier this year, the actress went into a clinic because she was suffering from anxiety and depression.
Locklear had been divorced from Bon Jovi guitarist Richie Sambora last year, after the couple had been married for 11 years.
