Harry Potter author JK Rowling in legal battle over photo
Best- selling author of the Harry Potter series JK Rowling has gone back to court again in her bid to prevent the publication of a photo of her son, David, when he was 18 months old, which she claimed was an invasion of privacy.

Last year JK Rowling had lost in a High Court action over this but now she is trying again although photo agency Big Pictures claim there is no evidence of any harm to the boy.

JK RowlingJK Rowling’s lawyer Richard Spearman QC said: "This claim is not about the rights of adults, this is about the rights of the child."

JK Rowling is claiming that she and her husband Neil didn’t know that the photo in question, which had been captured in 2004 in a street in Edinburgh, was being taken and hadn’t agreed to it.

In June 2005, after the picture had been printed in the Sunday Express magazine, an injunction stopping further publication of the photograph had been granted, along with damages for infringement of privacy.

However, a High Court judge had said the law did not give celebrities "a press-free zone for their children" although JK Rowling was not happy with the judge’s ruling.
