Penstone Kilembe had protested that the refusal of Kate Kainja, the Malawian minister of women and child development, to let him assess Madonna and husband Guy Richie's suitability could have stopped the entire adoption process happening and that the child might even have to be sent back to his Malawi village.
The Malawi High Court will consider the director of Malawi's child welfare services' testimony to determine if Madonna should be confirmed as an adoptive parent for the boy.
Penstone Kilembe denied he had obtained an air ticket and money from Madonna without official approval of the Malawi government as reportedly alleged by Kate Kainja, and he said that Madonna had been notified of the proposed visitation dates, which will last for two weeks from 4 September.
